Terms of Service

Welcome to AI Stamp ID ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, services, and applications (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Use of Services

  • You may use the Services only for lawful purposes and in accordance with these Terms.
  • You must be at least 13 years old (or older if required by your local laws).
  • You are responsible for the accuracy of any information you submit, including uploaded stamp images, and data.

2. Accounts

  • To access certain features, you may need to create an account.
  • You are responsible for maintaining the confidentiality of your login information and for all activities under your account.

3. Subscriptions & Payments

  • Certain Services require a paid subscription (e.g., intro and premium stamp identification uploads).
  • Payments are processed securely through third-party providers (e.g., Stripe).
  • Subscription fees are non-refundable except as required by law.

4. Your Content & Ownership

Your Rights

You retain ownership of all images, data, and other content ("User Content") that you upload to AI Stamp ID ("The Service". Nothing in these Terms transfers ownership of your User Content to AI Stamp ID.

Subject to your compliance with these Terms, AI Stamp ID grants you a limited, non-exclusive, non-transferable license to download, view, and use the annotated images, analysis results, and sales cards generated by the Services for your personal or commercial stamp-collecting and selling activities.

License You Grant to AI Stamp ID

By uploading User Content, you grant AI Stamp ID (Curiofury LLC) a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, analyze, modify, display, and otherwise use your uploaded stamp Content solely for the purpose of operating, displaying, providing, maintaining, improving, and developing The Services, including training and improving AI and machine-learning models.

This license includes the right to generate derivative outputs such as annotations, metadata, classifications, measurements, grading assessments, and other analytical results.

AI-Generated Outputs (including annotations, metadata, analysis results, and derived data) are owned by AI Stamp ID, while the underlying uploaded images remain your property.

Aggregated & De-Identified Data

AI Stamp ID may aggregate and de-identify User Content and AI-generated outputs to create statistical, analytical, or training datasets. Such aggregated or de-identified data does not identify you or your individual stamps and is owned by AI Stamp ID.

Our Intellectual Property

All aspects of the AI Stamp ID platform, including the website, software, algorithms, AI models, workflows, user interfaces, tools, features, documentation, branding, and AI-generated methodologies, are owned by AI Stamp ID (Curiofury LLC) or its licensors and are protected by intellectual property laws. All site content, tools, AI models, and features are owned by AI Stamp ID (Curiofury LLC) and may not be copied, distributed, or reverse-engineered without permission.

Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, license, reverse-engineer, or create derivative works from the Services or any AI models or tools without prior written consent.

Content You Are Allowed to Upload

You represent and warrant that you own or have the necessary rights and permissions to upload User Content to AI Stamp ID and that your uploads do not violate the intellectual property or privacy rights of any third party.

5. Prohibited Uses

You agree NOT to:

  • Upload illegal, harmful, or infringing content.
  • Upload personal data you don't have consent to share.
  • Use malware, phishing, scraping or evade rate-limits
  • Attempt to bypass security features or misuse the Services.
  • Use automated systems (bots, scrapers) to extract data without consent.
  • Reverse engineer/model extraction attempts.

6. Accuracy of Results

Our AI-based identification tools provide best-effort results but are not guaranteed to be 100% accurate. We do not guarantee authenticity, grade, condition, provenance, legality of sale, or market value. Any pricing comps/estimates are illustrative and may be outdated or inaccurate.

You agree that we are not liable for misidentification, errors, or financial decisions based on our analysis and outputs. You are responsible for double checking all results before using them or making decisions based on them.

7. Termination

We may suspend or terminate your account if you violate these Terms.

8. Disclaimer & Limitation of Liability

The Services are provided "as is" and "as available." We disclaim all warranties to the maximum extent permitted by law. We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, lost data, business interruption). Our liability to you is limited to the amount paid during the active subscription month.

9. Indemnification

You agree to defend, indemnify, and hold harmless AI Stamp ID, Curiofury LLC, and our officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Services, (b) your Uploaded Content, (c) your violation of these Terms, or (d) your violation of any law or third-party rights.

10. Governing Law

These Terms are governed by Oregon law (excluding conflict-of-law rules), except that the Federal Arbitration Act governs arbitration. Any dispute will be resolved by binding individual arbitration administered by the AAA under its Consumer Arbitration Rules in Yamhill County, Oregon (or remotely by agreement); no class, collective, or representative actions are permitted. Either party may bring an eligible claim in small claims court, and non-arbitrable disputes must be filed exclusively in state or federal courts in Yamhill County, Oregon.
